Pursuant to the Florida Workers’ Compensation Statute, the injured worker has the right to select their pharmacy.

440.13 Medical services and supplies; penalty for violations; limitations.

(3)(j) Not withstanding anything in this chapter to the contrary, a sick or injured employee shall be entitled, at all times, to free, full, and absolute choice in the selection of the pharmacy or pharmacist dispensing and filling prescriptions for medicines required under this chapter. It is expressly forbidden for the department, an employer, or a carrier, or any agent or representative of the department, an employer, or a carrier, to select the pharmacy or pharmacist which the sick or injured employee must use; condition coverage or payment on the basis of the pharmacy or pharmacist utilized; or to otherwise interfere in the selection by the sick or injured employee of a pharmacy or pharmacist.

You may have received a letter from a workers’ compensation insurance carrier incorrectly categorizing Injured Workers Pharmacy (IWP) business operations. Specifically, Travelers Insurance sent out a notification to many prescribers on April 17, 2026 stating “Notice to Third Party Dispensing Arrangements - This policy applies equally to medication billed through third-party dispensing companies or pharmacy benefit managers operating under physician affiliation arrangements (e.g., Prescription Partners, Injured Workers Pharmacy, or similar entities).” The letter suggested that the decision in Publix Super Markets, Inc., et al. v. Department of Financial Services, No. 1D2023-0941 (Fla. 1st DCA Feb. 25, 2026) may allow carriers to deny prior authorization based on that model. These statements are inaccurate and misrepresent both our business model and the scope of the ruling.

Travelers Insurance has since clarified in a letter dated May 18, 2026, that it does not dispute IWP is a duly licensed pharmacy holding a non-resident pharmacy license in Florida.

Travelers recognizes the Publix decision—which addressed prescribing practitioners acting as dispensers—does not apply to IWP’s operations. Travelers committed to remain fully compliant with Chapter 440 of the Florida Statutes to ensure injured workers retain unfettered access to the pharmacy of their choice, including IWP.

FL's Electronic Prescribing Requirements

House Bill 831 (2019), Electronic Prescribing, was signed into law with an effective date of January 1, 2020. The bill provides important new requirements for prescribers to generate and transmit all prescriptions electronically upon licensure renewal or by July 1, 2021, whichever is earlier.
