Pursuant to the Florida Workers’ Compensation Statute, the injured worker has the right to select their pharmacy.
440.13 Medical services and supplies; penalty for violations; limitations.
(3)(j) Not withstanding anything in this chapter to the contrary, a sick or injured employee shall be entitled, at all times, to free, full, and absolute choice in the selection of the pharmacy or pharmacist dispensing and filling prescriptions for medicines required under this chapter. It is expressly forbidden for the department, an employer, or a carrier, or any agent or representative of the department, an employer, or a carrier, to select the pharmacy or pharmacist which the sick or injured employee must use; condition coverage or payment on the basis of the pharmacy or pharmacist utilized; or to otherwise interfere in the selection by the sick or injured employee of a pharmacy or pharmacist.

House Bill 831 (2019), Electronic Prescribing, was signed into law with an effective date of January 1, 2020. The bill provides important requirements for prescribers to generate and transmit all prescriptions electronically upon licensure renewal or by July 1, 2021, whichever is earlier. What can I do if I’m told to use or switch to a specific pharmacy?
Under Florida workers’ compensation law, you have the right to choose your pharmacy.
Pursuant to Florida Statute 440.13(3)(j), injured workers are entitled to free, full, and absolute choice in selecting the pharmacy that fills their prescriptions. This means your employer, insurance carrier, or any representative cannot require you to use a specific pharmacy, condition your coverage on your choice, or interfere with your decision in any way.
If you are asked or told to use a specific pharmacy—or to switch from your current pharmacy—you are not required to comply if you prefer to stay with your chosen provider.

What does “free, full, and absolute choice” mean for me as an injured worker?
Under Florida workers’ compensation law, “free, full, and absolute choice” means that you are in control of selecting the pharmacy that fills your prescriptions—without restriction or interference.
This protection, outlined in Florida Statute 440.13(3)(j), ensures that:
- You can choose any pharmacy you prefer, including Injured Workers Pharmacy (IWP)
- Your decision cannot be limited or influenced by your employer, insurance carrier, or any representative
- Your access to medications and benefits is not tied to using a specific pharmacy
In practical terms, this means your pharmacy choice is entirely yours. No one else can make that decision for you, override it, or impose conditions based on it.

What if my doctor sends my prescription to a different pharmacy?
In some cases, your doctor may send your prescription to a pharmacy they commonly work with or have on file. However, under Florida workers’ compensation law, the choice of pharmacy ultimately belongs to you—not your doctor or any other party.
If your prescription is sent to a pharmacy you did not choose, you still have the option to select a different pharmacy that meets your needs.
What you can do:
- Inform your doctor’s office of your preferred pharmacy for future prescriptions
- Request that your prescription be sent to or transferred to the pharmacy of your choice
- Continue working with the pharmacy you trust for your care
Pharmacy selection should reflect your preference, and you have the right to ensure your prescriptions are filled where you feel most comfortable.

What if my doctor gives me a paper prescription instead of sending it electronically?
If your doctor provided a paper prescription, you can still use IWP. Simply contact our Patient Care Team at 1-888-321-7945, and we can send you prepaid overnight UPS labels via email or deliver them to your door.
Once you send your prescription to us, we’ll typically receive it the next business day. From there, our team will quickly process your medication and coordinate delivery so you can start treatment without delay.
